Overview
Mohamud M. Sheikh is the Managing Partner at Sheikh & Shariff Advocates and leads the Firm’s Dispute Resolution and Intellectual Property Law practices. He has represented local and international clients, State Corporations and Independent Commissions in commercial disputes, constitutional law, electoral disputes, employment and labour relations, insolvency, and property law. He has undertaken complex litigations, advisories and consultancies assignments including several appearances before the Court of Appeal, High Court, Employment and Labour Relations Court, Environment and Lands Court and all subordinate courts and tribunals of the Republic of Kenya.
Experience
- Part of a team of lawyers who successfully defended the Independent Electoral & Boundaries Commission (IEBC) and its Commissioners in the Presidential Election Petition E005, E001, E002, E003, E004, E007 & E008 of 2022 (Consolidated) challenging the election of the President in the 2022 General Election.
- Successfully represented the Independent Electoral & Boundaries Commission in Garissa High Court Election Appeal Number E001 of 2023- IEBC Versus Maymuna Abdishakur Sheikh
- Successfully acted for the Independent Electoral & Boundaries Commission in Mombasa High Court Election Appeal Number E002 of 2023 – Samir Gulam Abbas Baloo Versus IEBC & 2 Others as consolidated Election Petition Appeal No. E003 of 2023;
- Successfully acted for Independent Electoral & Boundaries Commission in Garissa High Court Election Appeal Number E008 of 2023- Salah Hassan Shafat Versus IEBC & 2 Others
- Successfully defended the Independent Electoral & Boundaries Commission in several election petitions that were filed in various courts following the 2017 General Election
- Was part of a team of Advocates that represented the 2017 elected Member of National Assembly of Wajir East Constituency in Mohamed Mohamud Sheikh v. Independent Electoral and Boundaries Commission & 2 others [2018] eKLR;
- Acted for Petitioners in Milimani High Court Constitutional Petition No.326 Of 2018, Global Africa Auto Tyres and Accessories Limited & Another V. KRA & 4 Others and successfully quashed the entire charge sheet and proceedings against the Petitioners in criminal case number 1726 of 2018, Republic v Ahmed Mohamed Osman and Global Africa Auto Tyres and Accessories Limited;
- Acting for Hass Petroleum Kenya Limited in various cases relating to recovery of multi-million debts and employment and labour relation disputes;
- Acting for the County Government of Mandera in several employment and labour relations disputes and disputes relating to breach of contract;
- Acting for the County Assembly of Garissa, its Speaker and Clerk in disputes relating to Azimio La Umoja, the Majority Party Leadership in the House;
- Part of the team that successfully represented the Board of Trustees, Water Sector Trust Fund in several Employment and Labour Relations disputes before the Employment and Labour Relations Court in Nairobi;
- Representing various clients in land disputes before the Environment and Land Court;
- Advised and acted for various corporate clients for registration of trademarks and patents in Kenya;
- Was consulted by the Wajir County Government and drafted By-Laws
- Advised several corporate clients on declaration of redundancy during the Covid-19 global pandemic;
- Represented several high-profile clients in tax disputes before Tax Appeals Tribunal and the High Court;
- Acted for several clients in public procurement dispute before the Public Procurement Administrative Review Board;
